Johannesburg - The National Prosecuting Authority (NPA) has asked for an extension of its deadline to submit its heads of argument in the so-called spy tapes case in which the Democratic Alliance (DA) is seeking a review of its decision to withdraw criminal charges against President Jacob Zuma after missing the deadline for handing it to court on Wednesday.

“They did not submit their heads of argument on Wednesday. Instead they asked for an extension to June 26,” James Selfe, the chairman of the DA’s federal council, said on Friday.
 
He said the DA refused, but said it would agree to an extension to Monday, which is also the date on which Zuma is to file his heads of argument.
 
The NPA could not be reached for comment.
 
The case has finally progressed to the stage of litigation about the actual review, after a battle of several years over the release of the so-called spy tapes cited by the NPA to drop the charges.
 
Selfe has said once the respondents had filed their papers, the DA would ask the deputy judge president of the North Gauteng division to determine a court date before the end of the month.
 
The DA is asking the High Court in Pretoria to rule that the NPA’s decision in Apriil 2009 to stop Zuma’s prosecution, paving the way for him to become president, was irrational, and therefore unlawful and unconstitutional.
