Mpshe files confirmatory affidavit in Zuma case─── 15:16 Tue, 30 Jun 2015
Pretoria - Former acting prosecutions chief Mokotedi Mpshe on Tuesday filed a confirmatory affidavit in the Pretoria High Court regarding his contested decision six years ago to withdraw criminal charges against President Jacob Zuma.
However, the National Prosecuting Authority, whom he headed at the time it scrapped the case, had yet to file its heads of argument opposing the Democratic Alliance’s application for a review.
Earlier on Tuesday, the DA said the NPA was in contempt of court after missing three deadlines to file the papers.
The DA is asking the high court to rule that the NPA’s decision in April 2009 to stop Zuma’s prosecution, paving the way for him to become president, was irrational, and therefore unlawful and unconstitutional.
The case has finally progressed to the stage of litigation about the actual review, after a battle of several years over the release of the so-called spytapes cited by the NPA to drop the charges.
