Bloemfontein - The Supreme Court of Appeal (SCA) has set aside a court order that prohibits the University of the Free State (UFS) from implementing its new language policy.

The SCA upheld the appeal with costs. It found that civil rights group AfriForum had not provided proof that any prospective student in any of the three affected faculties stood to be prejudiced by the introduction of the new language policy in 2017, which will see English become the primary medium of instruction.

From 2017, the UFS will roll out a pilot project of the new policy in three faculties - law, humanities and medical. From 2018, the policy will apply to first year students in all faculties except theology and education

In July, the High Court in Bloemfontein ruled in favour of AfriForum’s bid to stop the university from implementing this policy. In September, the university was granted leave to appeal the ruling.
