Atul Gupta’s High Court application opposing the freezing of R10 million from his personal account has been granted by Judge Fouche Jordaan.
Bank of Baroda and seven Gupta-linked entities have also emerged victorious today, with the preservation order against them also being set aside.
Referring to the order against Bank of Baroda, Jordaan said it can be noted “the funds flowing out of the Bank of Baroda’s Nedbank account are suspicious, but suspicion does not warrant a preservation order”.
Jordaan further amended seven other amounts in the original preservation order that was granted in January of this year. An amount of R220 million was previously preserved, with the order now amended, only R40 million has been preserved.
