Concerns have been raised over delays to bail application proceedings of the three men accused of playing a role in the murder of local businessman, Louis Siemens.

This as the matter was again postponed to November 9 in the Bloemfontein Magistrate’s Court today.

Two of the accused, Bayswater detective Molebatsi Mogoera and court orderly Kagiso Chabane, were supposed to formally apply for bail today. It was revealed that the legal representatives of the accused and the prosecution were again at loggerheads over suitable dates for proceedings to get underway, with Mogoera’s legal counsel expressing concern over the delays and how they impact the accused, who will remain in police custody till November. He said they wanted a closer date, but this was not possible.

Stanley Bakili, who was without legal counsel during his last appearance on 7 September, has obtained representation and made it known that he would exercise his right to apply for bail. Bakili had previously, in a twist of events, abandoned his bail application on the back of numerous appearances.

The prosecution said the investigating officer is also busy finalising certain aspects of the investigation, and as a result, the prosecution is also not in a position to proceed today. The Magistrate echoed the sentiment that the delays had been problematic. She said a bail application, in its nature, is an urgent application. It was revealed that proceedings will be moved from courtroom 20 to another courtroom so that it can be dealt with separately and does not clash with the court roll for room 20.

Meanwhile, outside the court building, Bakili’s relative declined to speak to OFM News on the matter. Siemens, the Director of the day hospital, City Med, was shot four times in the basement parking area of Preller Square on Thursday, May 10. Bakili was apprehended for his involvement that same day. Prosecutor Advocate Johan de Nysschen previously revealed that Bakili had been linked to the murder via CCTV footage and messages sent to Siemens. The police officers were arrested at the end of August for helping Bakili orchestrate the crime. Siemens’ other assassins are still at large.
