The incident occurred at the time when Nevelling was also prosecuting high-ranking officials in the North West, including former Finance MEC Wendy Nelson.
Nevelling is currently out on R500 bail.
Reasons advanced by the court is that the National Prosecuting Authority has since studied the docket in order to determine whether the matter warrants a prosecution.
