The man accused of raping a seven-year-old girl at the Dros restaurant in Silverton was on Friday declared fit to stand trial.
He allegedly raped the girl in the restaurant's bathroom in September last year.
The case is postponed to 5 March.
Twenty-year-old Nicholas Ninow was sent to the Weskoppies Psychiatric Hospital for observation.
His legal team has argued he has a history of mental illness.
They admitted he's been a drug user since he was fourteen and was diagnosed with bipolar disorder since 2013.
