#FSANC expresses support for Busisiwe Mkhwebane's office─── LUCKY NKUYANE 08:59 Thu, 13 Jun 2019
Following the Public Protector Busisiwe Mkhwebane's controversial Estina Dairy report into the alleged involvement of Ace Magasgule, the Free State ANC has expressed its confidence in Mkhwebane's office.
During a media briefing on Monday at the party’s provincial headquarters at the Kaizer Sebothelo Building in Bloemfontein, the Provincial Secretary, Paseka Nompondo, says the party believes and trusts in her office. This as Mkhwebane's report into Magashule’s alleged involvement on the allegations of massive corruption where millions of rands are said to have been siphoned off through dubious ways, cleared Magashule of any wrongdoing.
Her report was later set aside by the court declaring it as illegal and invalid after the DA and the Council for the Advancement of the South African Constitution (Casac), applied to have Mkhwebane's report on the project declared unconstitutional, reviewed and set aside. Nompondo says the ANC in the FS views the Office of the PP as an important institution in deepening the party's participatory in the country's democracy.
Mkhwebane's office has, however, since said she was considering appealing the Gauteng High Court in Pretoria's decision to set aside her report on the Estina Dairy Farm Project. Mkhwebane said she was concerned about the ruling, adding that it might be interpreted as though the court condones maladministration attributed to the parties against whom the report's findings were made. She said she would also consider applying for direct access to the Constitutional Court regarding the ruling which she "disagrees with fundamentally". In the statement, Mkhwebane's spokesperson, Oupa Segalwe, said she would be arguing the merits of her case at the apex court, rather than arguing them in the media.
