#FSANC: Further court action possible─── LUCKY NKUYANE 10:12 Thu, 13 Jun 2019
Further court action is looming within the Free State African National Congress (ANC) over an enforcement court order.
This as the ANC wants the court to issue a court order to the disgruntled ANC members who lost two court cases against the Provincial Executive Committee’s (PEC) legitimacy to pay the cost, as was ordered. The FS ANC has been embroiled in a factional battle that even led to the disgruntled members threatening to withdraw their votes just before the general election in May after losing these court bids to have the party’s PEC declared invalid and unconstitutional.
In February 2019, Judge Fouche Jordaan, in his judgment, dismissed their case against the PEC saying he was not convinced by the applicants' head argument and that they disregarded the most vital factors in the case when they failed to consider that the ANC did re-run the election of members at Branch General Meetings. The party’s provincial secretary, Paseka Nompondo, says despite these issues the party will continue to engage the disgruntled members.
Meanwhile, the party says it has noted the development in some of the embattled ANC-run municipalities in the province which include, Maluti-A-Phofung, amongst others. Nompondo further says the party has further noted the arrest of some of the officials in these municipalities, which include Kroonstad municipal manager, Simon Mqwathi, amongst others. The party has further expressed confidence in the newly elected Moqhaka mayor, Lucky Phoko.
With regards to the millions of rands owed to the different service providers by municipalities in the province, such as the power utility Eskom, the party says the PEC resolved to call on the FS premier, Sisi Ntombela, to intervene in the matter.
