The JB Marks Municipality's mayor and his co-accused, who is the former acting municipal manager (MM), have been ordered to not set foot at the municipal offices following their arrest by the Hawks on Friday.


The Potchefstroom Magistrate's Court told Mayor Kgotso Khumalo and the Director for the municipal services and local economic development, Cyril Henry, to not enter the building of the municipality until the conclusion of their fraud and theft cases. 

They were again ordered to not contact any witnesses while the investigations continue and more arrests are expected. The two are facing charges of fraud and theft amounting to R5 million after they allegedly accepted money which was intended for the municipality, in their accounts. 

Meanwhile, the Democratic Alliance (DA) has welcomed the arrests and said it is hopefully the first of a few more needed in relation to the alleged gross financial mismanagement, fraud, and corruption.

Khumalo and Henry were released on a warning in the Potchefstroom Magistrate's Court on Friday. The Hawks spokesperson, Tlangelani Rikhotso, previously said the arrest of the duo emanates from investigations into a trust account where the money, which was intended for the municipality, was deposited but instead was used for personal purposes. 

Rikhotso added that the funds were, however, never declared to the Auditor-General (AG), Kimi Makwetu. The case against the two has been postponed to 1 December for further investigations and they were ordered to not sit foot at the municipal building.
