#PrellerSquareShooting: Accused to apply for bail─── LUCKY NKUYANE 06:44 Wed, 25 Nov 2020
Some of the accused in the murder trial of former CityMed Managing Director Louis Siemens are expected to apply for bail at the Bloemfontein High Court soon.
Judge Pitso Molitsoane, during the continuation of Siemens' murder trial where eight men stands accused of murder, indicated on Tuesday that he was informed that some of the accused who have been in custody for at least two years have expressed their intention to apply for bail. They will apply for bail through legislation via a section called 49(G) which allows them to apply for bail directly to Molitsoane.
The application via this section depends on whether the accused have been directly implicated by the state's key witness during the testimony in the trial. If not, the accused then have a constitutional right to invoke the section and seek to be released out on bail while the trial continues. Two police officials, including Bayswater detective Molebatsi Mogoera, court orderly Kagiso Chabane, and former military man, Clive Tshivenga, are likely to invoke this section.
Mogoera and Chabane were arrested in August 2018 respectively while Tshivenga was nabbed on January 25, 2019.
Amongst those still in custody, it's only Mogoera, Chabane and Tshivenga who have not been directly implicated in the damning testimony of the state's key witness, Xolisile Botha Mbebetho, who is, during his testimony, connecting some of the dots in the brutal murder of Siemens.
Murder accused Stanley Bakili and accused number four, Mojalefa Jali Molusi - who was with Mbebetho during the murder of Siemens in the basement parking of Preller Square - have been heavily implicated.
