Judgement expected in Horner bail appeal─── LUCKY NKUYANE 06:13 Fri, 18 Dec 2020
Judge Celeste Reinders is expected to deliver judgement in the bail appeal of one of the Brendin Horner's murder accused in the Free State High Court.
First accused Sekwetje Mahlambi is contesting Senekal Magistrate's Deon Van Rooyen's decision to deny him bail.
Advocate Joseph Kgolenya, who is representing Mahlambi, says Van Rooyen failed to take into account all the evidence placed before him.
He also told Reinders that Van Rooyen relied on the state's key witness and leading investigator, Captain Pieter Myburgh, who he says was evasive in his testimony and didn't have all the details of the case.
Meanwhile, the state's prosecutor argued that Mahlambi failed to prove beyond reasonable doubt that the state does not have a prima facie case against him.
