The former ANC Free State Provincial Executive Committee (PEC) will be awaiting directives and guidelines from the national structure on the way forward following the court judgment which declared it as unconstitutional and unlawful.

Former PEC spokesperson, Thabo Meeko, says they will reflect on the issue through the guidelines of the national structure before taking any course.

On Wednesday, the Bloemfontein Supreme Court of Appeal (SCA) upheld the leave to appeal a bid by a disgruntled group of ANC members with costs and said the provincial conference was held in violation of a court order of 29 November 2017.

The group had argued that the Branch General Meetings (BGMs) were illegally constituted because those who attended the Ilanga Estate conference were those from the nullified 2017 Nasrec delegation, which emanated from the Parys conference. Meeko says in principle they accept the court’s outcomes.

“We accept the outcomes of the court and we reserve the right, of course, for a recourse when we are not happy with the outcome of the higher court. The ANC will have to look deeper into the issues and make that determination. Remember these matters are bordering on the unity of the ANC,” he adds.

Meanwhile, the National Executive Committee (NEC) is expected to convene following the outcomes. The national spokesperson, Pule Mabe, in a media statement says they call on all structures in the province to remain disciplined and calm whilst the party is studying the judgment and its implications.

In 2018, the High Court Judge Fouché Jordaan dismissed the group's bid to overturn the validity of the conference and said he did not believe this group had a solid case against the PEC, and believed that they made the court bid to score political points within their faction.
