The organisation for social justice, the Liberty Fighters Network (LFN), and its president Reyno de Beer have lodged an application asking the Bloemfontein-based Supreme Court of Appeal (SCA) judges to recuse themselves from the sitting on Wednesday.

Minister of Cooperative Governance (Cogta), Nkosazana Dlamini-Zuma, petitioned the SCA to set aside the findings of the Pretoria-based High Court over regulations issued in terms of the Disaster Management Act in 2020.

De Beer says judges allocated to the appeal case "appear as if they have outsourced their decision to go virtual to an administrative party". De Beer and his organisation says “this could mean the allocated judges even breached their oath of office and deviated from the legal norm to assist the official narrative.” 

Dlamini-Zuma argues further that Judge Norman Davis, during the judgment in 2020, lead evidence beyond pleadings by finding that level 3 was unconstitutional and he did not apply the rationality test correctly to the six regulations on which its decision turned.

De Beer and LFN adds that they will continue in their efforts to support real justice throughout South Africa.

De Beer and LFN successfully challenged the constitutionality of lockdown level 3 and 4 in 2020 at the North Gauteng High Court in Pretoria.
