NW SAPS officers to be charged with negligence─── LUCKY NKUYANE 13:19 Tue, 31 Aug 2021
Two North West police officials, under whose lawful captivity and care a suspect fatally shot himself, will be charged according to internal police procedures.
This is confirmed by the Independent Police Investigative Directorate (IPID) spokesperson, Grace Langa. She says the police watch-dog IPID will recommend that the officers from Makapanstad be charged in terms of the Firearm Control Amendment Act for the negligent handling of a fire arm. The police officials allegedly left the suspect alone whilst only one of his hands was cuffed to a chair, where he managed to search a bag, found a gun and then allegedly shot himself. This after the two officers arrested the 28-year-old man for house breaking.
Langa explains that both officers will have to be charged internally because:
1.They hand-cuffed the suspect 's one hand to the chair which we consider as not hand-cuffed because hand-cuffing should be both hands and not one.
2. They both left the suspect unattended. No suspects should be left alone without a guard in anyway possible, unless the suspect is in the cells.
She says the Fire Arm Control Amendment Act of 2000 states clearly that a fire arm should always and at all times be in the possession of the owner and inside a holster.
"The act committed in this instance was gross negligence.
IPID is investigating and will recommend both criminal and internal disciplinary actions against the officers," Langa further adds.
