The reinstated head of the Free State's Public Protector’s Office has made more damning allegations against the suspended Public Protector (PP) at a Parliamentary inquiry that is probing her fitness to hold office.

According to the Head of the PP’s office in the province, Hamilton Samuel, Mkhwebane was conflicted. He made mention of an incident where Mkhwebane was seen in a picture with politicians at her 50th birthday celebrations, such as former Free State Agriculture MEC, Mosebenzi Zwane, who was amongst those implicated in the failed Vrede Dairy Farm project.

On Wednesday, Samuel made serious allegations against Mkhwebaen and claimed that she had given an order that politicians, like suspended ANC Secretary-General (SG), Ace Magashule, must not be investigated by her office in the province.

During cross-examination, Samuel this afternoon told Mkhwebane’s legal counsel, Senior Counsel (SC) Dali Mpofu, that Mkhwebane lacked practical interpretation of the law. One of the pages in Samuel’s affidavit said; “It is in her modus operandi to tarnish the image of those that she is targeting by laying charges against them, just to have their name tarnished. This she does especially to senior managers who she perceives to be a threat to her intellectual and legal knowledge, which I submit she lacks considerably. She has also used this tactic to have colleagues who qualify and are interested in applying for positions like the Deputy Public Protector.

Mpofu then questioned Samuel, asking if he wanted the position of Deputy Public Protector (DPP). However, Samuel denied that he wanted the position. He says certain events have exposed the alleged lack of leadership from Mkhwebane.

Samuel told the Parliament's Section 194 Committee that Magashule and Zwane did not cooperate during the investigations into the Vrede Dairy Project.

Whilst testifying against the suspended Mkhwebane in Parliament on Wednesday, Samuel said he even escalated the matter about the politicians to Mkhwebane. She, however, told him that she did not want any findings against politicians.
