Ousted Centlec CFO challenges High Court sentence | News Article

The ousted Chief Financial Officer (CFO) of Bloemfontein’s power utility – Centlec – intends to challenge her sentence by a Free State High Court Judge.

Hlonelwa Nkomo wants her 3 months suspended sentence repealed and set aside.

In August 2022 Judge Joseph Mhlambi slapped Nkomo with a three-month suspended sentence after she was found to be in contempt of the court.

She says she believes another high court would come to a different conclusion on the matter.

Nkomo has made accusations against four high court judges. In her court application she requests that these four; Judge Soma Naidoo, Judge Nokuthula Sylvia Daniso, Judge Mhlambi and Judge Celeste Reinders should not be included in the case.

“I would like to humbly submit that another judge or a full bench should not include Judge Naidoo, Judge Daniso, Judge Mhlambi and Judge Reinders in the interest of unbiased, unprejudiced and fair proceedings,” she says in her application.

She says the courts are obliged to be fair with regard to litigants who appear before them, and that each case should be treated on its own merits without depriving a litigant of their constitutional right in accessing the right to equal protection and benefit of the law.

In July 2022 court documents furnished by Centlec, indicated that Judge Naidoo made a ruling which prevented Nkomo from mentioning details which were then yet to be aired in court with regard to an application she had made in June against Centlec Chief Executive Officer (CEO), Malefane Sekoboto.

She wanted the court to declare Sekoboto a delinquent manager.

However, her bid to have a court of law declare Sekoboto as such has failed. This, after Judge Daniso on 29 August 2022 ruled against her in favour of Sekoboto - who had opposed the matter under the banner of Centlec.

Nkomo has since criticised Centlec for allegedly using taxpayers’ money to defend Sekoboto and also said the entity ventured into matters that were not about the entity but about its CEO’s conduct.

She said the civil litigation against Sekoboto had nothing to do with the entity, however, its money is being used to fight his battles and that the interdict against her, filed by Centlec, had no jurisdiction in the case between Sekoboto and her.

Meanwhile, the ANC’s Interim Provincial Committee (IPC) coordinator, Paseka Nompondo, had announced that plans were afoot to dissolve the controversial Centlec board.
