A senior state advocate in the Asset Forfeiture Unit (AFU) in Kimberley has been denied bail after appearing in court on a string of domestic violence-related charges.
Lucas Motshabi, 42, faces charges of contravening a protection order, malicious damage to property, and assault with intent to cause grievous bodily harm. Gauteng National Prosecuting Authority (NPA) spokesperson Lumka Mahanjana says Motshabi’s wife obtained a protection order against him in November in the Pretoria North Magistrates’ Court.
The situation reportedly escalated in December when both parties opened criminal cases against each other. They were subsequently arrested and released on bail, with the matters postponed to February.
During the February court appearance, both parties withdrew their cases against each other following mediation.
Direct violation of bail conditions
Only days later, on 21 February, Motshabi allegedly returned unannounced to the residence previously shared by the couple in Pretoria North. This was in direct violation of his bail conditions, which prohibited him from returning to the property.
An argument reportedly broke out, during which Motshabi allegedly assaulted the complainant. It is further alleged that he removed children’s clothing from a wardrobe in the presence of a minor, damaged the motor gate, and deflated all four tyres of the complainant’s vehicle before leaving the scene.
She reported the incident to the police. Following an investigation, Motshabi surrendered to the police and was arrested on 3 March.
Prosecutor Tumelo Letaoana opposed bail, citing the seriousness of the offences, the violation of a protection order, and concerns for the complainant’s safety.
The state also argued Motshabi posed a flight risk after allegedly concealing his Kimberley address. The court agreed and denied bail.
The outcome reinforces the stance of the NPA that domestic violence will not be tolerated, regardless of the accused’s professional standing, said Mahanjana.
The decision affirms the authority’s commitment to protecting victims and upholding the rule of law without fear, favour or prejudice, she added. The case was postponed to 7 May for the Regional Court screening.
