In loco inspection in Carl Pistorius case

Vanderbijlpark - The magistrate in the culpable homicide trial of Carl Pistorius, brother of murder-accused paralympian Oscar Pistorius, decided on Thursday that an inspection in loco of the accident scene was needed.

During cross-examination in the Vanderbijlpark Magistrate's Court, Pistorius's lawyer Kenny Oldwage put it to Constable Robert Raphadu that his measurements at the accident scene were incorrect.

He also questioned Raphadu's sketch of the scene.

This prompted Magistrate Buks du Plessis to call for the on site inspection, which the media would not be allowed to film.

"I would ask the media to respect that it is still the court being in session there," said Du Plessis.

Maria Barnard died when her motorbike collided with Pistorius's bakkie in 2008. Pistorius is on trial on a charge of culpable homicide.

Raphadu testified earlier that Barnard was still alive when he arrived at the accident scene on March 8, 2008.

"I tried to talk to the accident victim, I was close to her. I didn't smell alcohol."

Oldwage asked Raphadu about the length of the tape measure he used.

"I'm not sure about the distance of the tape itself, but it was longer than the distance we measured," he said.

Olwage put it to him that he did not measured the distance, but guessed what it was.

He presented Raphadu with numerous pictures taken at the accident scene later that day.

Raphadu conceded that there were differences between the pictures and his sketch of the scene.

"That one does not look like mine," Raphadu said.

Asked why there were discrepancies he said: "I was there physically and you came later. That's why your photo is wrong."

Oldwage asked Raphadu if he had received any vehicle collision training before attending the accident scene.

"No, I don't have. I only know how to draw a plan when I'm at the scene only."

Pistorius's sister Aimee and his father Henke were in court.
