The JB Marks Municipality's Mayor and his former acting Municipal Manager (MM) have been released on a warning in the Potchefstroom Magistrate's Court on Friday.


Mayor Kgotso Khumalo and his accounting officer, Cyril Henry, were arrested on Friday morning by the Hawks on charges relating to fraud and theft, amounting to R5 million. 

The Hawks spokesperson, Tlangelani Rikhotso, says the arrest of the duo emanates from investigations into a trust account where the money, which was intended for the municipality, was deposited but instead was used for personal purposes. Rikhotso adds that the funds were, however, never declared to the Auditor-General (AG), Kimi Makwetu. The case against the two has been postponed to 1 December for further investigations and they were ordered not sit foot at the municipal building.


"Through the investigations, it was discovered that a series of payments were allegedly made from the said trust to their personal bank accounts instead. In some instances the funds were allegedly paid to service provider’s accounts for services that were never rendered, thereafter, the money would be allegedly collected by the suspects for themselves. Investigations continue and more arrests cannot be ruled out,” she adds.

It is alleged that the funds in the trust were misrepresented to appear as if they were being used to pay for services rendered to the municipality, meanwhile invoices were allegedly being falsified.
