This time, Roger Nkhumise is facing charges of contravening municipal legislation at the Moretele Municipality.

Nkhumise, who is also a former Moretele Municipal Manager (MM), is now accused of allegedly irregularly awarding a multimillion-rand IT tender worth R215 million in 2016. 

According to the Hawks' spokesperson, Tlangelani Rikhotso, the IT company was allegedly appointed without a competitive bidding process. Rikhotso says following the appointment of the IT company at Moretele, the contract was extended, thus deviating from the prescripts of legislation governing the municipality’s tender system.

Rikhotso adds that the pricing for the contract was allegedly also different from the pricing of the previous, inherited contract. Nkhumise faces four counts of contravention of the Municipal Finance Management Act.

The matter was postponed to 17 August 2022.

“The original contract between Flame IT Strategy and Madibeng Local Municipality was reportedly remaining with only twenty-three (23) months until the conclusion, however, the Moretele Local Municipality appointed the said service provider for three (3) years. The service provider was allegedly appointed without a competitive bidding process and thereafter the contract was extended, thus deviating from the prescripts of Regulation 32. The accused faces four counts of contravention of the Municipal Finance Management Act (MFMA) 56 of 2003, read with Regulation 32 of the Municipal Supply Management Regulations,” Tlangelani adds.

Meanwhile, the Provincial Head of the Directorate for Priority Crime Investigation in North West, Patrick Mbotho, warned that "people who use their positions of power to promote criminal activities will face the full might of the law".

The Special Investigation Unit (SIU) in 2020, whilst Nkhumise was the Municipal Manager at Matlosana, raided the municipality’s offices and seized documents following allegations of wrongdoing.  SIU spokesperson Kaizer Kganyago at the time said the raid, related to the R47 million that was allegedly used for Personal Protective Equipment (PEP) purposes, was done in a corrupt manner and that’s why we are here.
