He said they were more than convinced that the suspect faces a mere schedule 1 offence and does not have an overwhelming case as it previously mentioned.

Defence advocate Frans Dhlamini said the state has lied and contradicted itself on the affidavit of the state witness and the charge sheet. He questioned why only 2 charges out of the 16 she has been slapped with would constitute a schedule 5 offence? He said they were more than convinced that the suspect faces a mere schedule 1 offence and does not have an overwhelming case as it previously mentioned.


Dhlamini said the state failed to produce evidence for its so-called "overwhelming case against Magudumana".

He also explained Magudumana was only denied practicing for not paying a minimum prescribed fee and that she still remains a doctor. He said nothing so far from the state's witness and police officer Tieho Flyman's affidavit has been provided as evidence to prove that Magudumana should not be granted bail.

Dhlamini also disputed the fact that the suspect faces further possible charges of fraud separate from the Thabo Bester escape saga. He said the six fraud cases the state mentioned during opening or heads of argument in the bail application were not registered and as such Magudumana is not a suspect in those cases.

The case was postponed to Monday (4/9) whilst Adv. Dhlamini was still on the floor. His colleague, Adv. Machini Motloung, will complete a set of closing arguments against the state on the aforementioned date. The state prosecutor Sello Matlhoko will then have an opportunity to deliver his closing argument for the state.

On Tuesday (29/8) Matlhoko said Magudumana has no regard or respect for the law. He said she is looking at a lengthy jail term for her alleged role in aiding a convicted rapist and murderer to escape from lawful custody.  


He said if released on bail there is a likelihood that the suspended doctor could evade trial or interfere with state witnesses. Magudumana faces a string of charges which include fraud, corruption, aiding, and abetting Bester to escape from lawful custody, and violating a corpse.

Magudumana previously claimed in her affidavit during her bail application that she was forced and threatened by accused 5 and her boyfriend Thabo Bester to flee the country.

Monies involved in these cases range from R15 million, R5.112 million, R1.2 million, R900 000, R500 000, and R150 000. She fraudulently claimed at least two bodies from the state mortuary in Bloemfontein, including that of Katlego Bereng, which was used as a decoy for Bester to escape from G4S in May 2022.

She is among 12 suspects arrested for aiding Bester to escape. Nine suspects, including accused 1, Senohe Matsoara, are out on R10 000 bail. It is only Magudumana, Bester, and an illegal immigrant from Zimbabwe Zando Moyo who remain in custody.
