Dolus Eventualis: Intention to kill or not? #OscarPistorius─── 12:02 Tue, 03 Nov 2015
Bloemfontein - The State’s appeal against former paralympian Oscar Pistorius’s culpable homicide conviction is being heard in the Bloemfontein Supreme Court of Appeal today.
The State is asking the Supreme Court of Appeal to substitute the conviction of culpable homicide with one of murder with accordance to dolus eventualis.
Dolus eventualis is when the accused is said to could have objectively foreseen the consequences of his/her act causing death and persisted regardless of the consequences.
