Mkhwebane finds appoint at NC Municipality irregular | News Article
Public Protector Busisiwe Mkhwebane

The Public Protector (PP), Busisiwe Mkhwebane, has confirmed that allegations of improper conduct and maladministration at the ZF Mgcawu District Municipality in the Northern Cape are substantiated.

Mkhwebane's findings follows a complaint that lodged on 11 November 2016 by an official from the South African Municipal Work Union (SAMWU).

She says the appointment of a unit manager for special projects resulted in irregular expenditure in September 2016 with regards to the remuneration paid to her, as stipulated in the relevant section of the Municipal Finance Management (MFA) Act.

Mkhwebane, in this light, further requested the Municipal Manager (MM) to institute disciplinary action against the officials who were involved in the irregular appointment.

Meanwhile the Municipality’s spokesperson, Martha Manyeh, says the municipality takes note of Mkhwebane’s report and further adds they will study the contents of the report, its findings and recommended remedial actions.

Manyeh adds that the municipality will give a full statement once they have studied the contents of the report.

“Upon analysis of the complaint, I decided to investigate only two issues. First, I investigated whether the appointment complied with the recruitment policy of the municipality”

“Second, I investigated whether her appointment was improper and constituted maladministration,” Mkhwebane adds.

“Her appointment, therefore, constituted improper conduct as envisaged in the Constitution and maladministration as envisaged in the Public Protector Act,” she further says.

Mkhwebane has further directed the MM to take appropriate steps within 30 working days from the date of this report to review the Recruitment Policy of the municipality to bring it in line with the provisions of the Municipal Systems Act.
