NW High Court reinstates suspended managers─── LUCKY NKUYANE 14:06 Tue, 25 May 2021
The High Court in the North West has dismissed the suspension of two senior officials who were previously suspended for misconduct at the Vryburg-based Dr Ruth Semotsi Mompati District Municipality.
The High Court ruled that the suspension of these two officials, including the Senior Manager of Engineering and Technical Services, and the Chief Financial Officer was inconsistent with the disciplinary procedure, therefore unlawful and invalid. The duo was suspended in March 2020 by the municipality over the alleged misconduct but the court has now ordered that they resume their duties with immediate effect.
The High Court has further ruled that the local government department must take appropriate steps to enforce compliance by the municipality. The municipality is yet to comment on the OFM News inquiry.
The suspension was set aside by the High Court following a court action by the two following their suspension. The order slapped the municipality, municipal council, speaker, and the municipal manager (MM) with costs.
