Murder accused ANC MP's lawyer no-show at court─── LUCKY NKUYANE 15:31 Wed, 26 Apr 2023
A defence attorney for ANC Member of Parliament (MP) accused of murdering his wife in North West was a no show on Wednesday 26 April 2023 at Orkney Magistrate's Court.
The spokesperson for the National Prosecution Authority (NPA), Henry Mamothame, said this forced the Magistrate to postpone the case against murder accused Sibusiso Kula to 10 May 2023 for legal representation. A warrant of arrest was issued for Kula after he failed to show up in court but was later concealed when he made his appearance.
Mamothame says Kula could not also account for the whereabouts of his defence attorney. The case against Kula is still at the Magistrate's Court and is yet to be transferred to either the regional or High Court. According to Mamothame, this is because the NPA is awaiting the completion of police investigations and the authorisation by the Director of Public Prosecution (DPP).
Kula was arrested on Friday, 20 January 2023, in Kanana, near Orkney, on a charge of murdering his 31-year-old wife Jeniffer Mohlomi-Kula.

In the previous court hearing, his attorney registered their intention to present an application to oppose further postponement. He further registered their intention to challenge certain procedural matters relating to Kula’s first appearance in court.
Kula is currently out on bail, after the High Court of South Africa North West Division; granted him R50 000 bail, following his appeal on the Orkney Magistrate’s Court decision to deny him bail.
He was ordered to surrender his passports, report twice a day at the nearest police station, provided the investigating officer with his work itinerary, and report to the investigating officer if he must move outside his residential jurisdiction and have no direct or indirect contact with his children," Mamothame says.
Meanwhile, an application has been submitted to the office of the Director of Public Prosecutions in North West, Dr Rachel Makhari, for the matter to be transferred to a higher court, owing to its serious nature. Investigations are nearing completion as the state prepares for trial.
"Police reports reveal that Kula’s wife, Jennifer Mohlomi, was found murdered on 27 November 2022, in what seemed like a robbery. She was found with a stab wound on her back but the object that was used for her alleged murder has not been recovered. The matter was reported by the medical facility where she was allegedly transported to by the accused to receive medical attention. The accused told the police that he was not present at his home when the incident occurred."
Mamothame adds that following thorough investigations by the police, he was linked to the alleged murder and was arrested on 20 January 2023 and charged with murder.
