NPA advises assaulted man to open case | News Article

The National Prosecuting Authority (NPA) has advised a man who was allegedly assaulted by a police officer in Kestell in the Eastern Free State to open a case.


The assault allegedly occurred on Sunday after Sefako Radebe received two stolen bags of cement from a friend to keep in his house. Radebe appeared before the Kestell Magistrate’s Court on Wednesday and was released without bail conditions.

The NPA provincial spokesperson, Phaladi Shuping, told OFM News that the police are not allowed to assault a suspect as it is against the law. Shuping also advised Radebe to properly record his injuries in the J88 form during his medical examination.

Radebe’s sister, Zanele Radebe, told OFM News that her brother was arrested after allegedly being assaulted and was released on Monday, with a referral letter to go see a doctor at a clinic. She explained that they do not have transportation and was unable to take Radebe to the local clinic as he was unable to walk because of his injuries. An ambulance was called and he was taken to Elizabeth Ross Hospital in Qwaqwa.

Shuping further added that Radebe should, during his next court appearance, notify the judge that he wants to lay a charge of assault against the police officer. He also stated that Radebe should inform his lawyer so that the case would be reported to the Independent Police Investigative Directorate (IPID).

Police spokesperson, Mmako Mophiring, confirmed that a case of theft was opened against a suspect and the investigations are underway. The suspect is expected to appear before the Kestell Magistrate's Court on 4 December 2019.
