Judge Masipa to decide on Oscar appeal─── 12:58 Tue, 04 Nov 2014

Pretoria - Judge Thokozile Masipa will hear the State's appeal against Paralympian Oscar Pistorius's conviction and sentence for the shooting death of his girlfriend, Reeva Steenkamp.
The National Prosecuting Authority filed the application this morning for leave to appeal both the culpable homicide conviction and the maximum five year jail sentence. The State is seeking a conviction on a charge of premeditated murder, which carries a far heavier prison sentence.
An attorney and director at BDK Attorney's, Ulrich Roux, says the State's challenge is to convince Judge Masipa that a different court will come to a different conclusion, based on the facts on record during the trial.
Roux says he expects the State to push for the matter to be heard before the courts go into recess on December 15. The State will also push that State Prosecutor Gerrie Nel would lead the application.
