Ramaphosa draws battle lines─── LUCKY NKUYANE 05:56 Mon, 22 Jul 2019
The battle lines have been drawn between President Cyril Ramaphosa and the Public Protector, Busisiwe Mkhwebane.
This is Ramaphosa on Sunday night announced on national television that he is taking a damning report against him for a judicial review and hopes that matter will be done so expeditiously.
On Friday Mkhwebane said Ramaphosa was guilty of violating the constitution and misleading parliament relating to donations made by Bosasa’s Gavin Watson to his CR17 campaign for the ANC presidency.
Ramaphosa says after careful consideration and consultation with his legal representatives a conclusion was reached that Mkhwebane's report is fundamentally and irretrievably flawed. Ramaphosa says his actions in this regard is not to disrespect or undermine the office of chapter nine institutions or Mkhwebane herself.
Ramaphosa says the findings by the office of the public protector are of serious nature especially for sitting president like he is.
He adds that Mkhwebane's report lacks a sound legal basis, is irrational and also lacks fair and even impartial process amongst others.
"The reports contains numerous factual inaccuracies of a material nature, the findings found are wrong in law, are irrational and in some instances exceed the scope of the powers of the public protector."
"Furthermore in failing to provide me with an opportunity to comment on the proposed remedial action, the public protector has violated the provisions of the (PP) Act, the constitution and the principles of our law," Ramaphosa added.
Ramaphosa says given what he says are deficiencies and consistent with the constitutional architecture it is appropriate that the courts of the country make a final and impartial determination on the matter.
