Mkhwebane to petition Supreme Court over Vrede Dairy costs judgment─── LUCKY NKUYANE 08:41 Sat, 14 Dec 2019
The Public Protector(PP), Busisiwe Mkhwabane, has confirmed that she will approach the Supreme Court of Appeal (SCA) over the Gauteng High Court's judgement.
The High Court's judgement dismissed her leave for appeal against the personal costs judgment over the controversial Estina Dairy Farm project.
On Friday, Judge Ronel Tolmay said Mkhwebane failed to make out a case on the merits of the Estina dairy farm judgment and with regard to costs.
Later the same day on Twitter, Mkhwebane asked what kind of justice was served by Tolmay's judgement.
The controversial Vrede project implicates former Free State(FS) Premier, Ace Magashule and former MEC Mosebenzi Zwane over their alleged involvement in siphoning millions of rands from the project for their personal benefit.
Meanwhile, Mkwhebane continued on her Twitter page:
”I hope other PP’s won't have to deal with what I've been through; harassed daily including my family; certain journalists tasked to deal with me and questionable judgements”
“It looks like we are faced with a constitutional crisis,” she adds. Mkhwebane further says she never thought she would see this post-1994.
“The problem with judgments based on media headlines is they set a bad precedent and will affect other constitutional institutions including African ombudsman,” Mkhweabena added.
