Government isn't being given more time to prepare its defence of the tobacco sales ban. Its second attempt at a postponement has been dismissed.
The Fair Trade Independent Tobacco Association has taken government to court over the prohibition of cigarette sales.
Government says a postponement should be granted because the country has now moved to Level 3.
But Judge President Dustan Mlambo says both parties agreed the matter would be heard in early June.
If government still feels the need to apply for a postponement, it should do so in accordance with the rules of the court.
The case is due in court next week.
