The Democratic Alliance has filed an urgent application in the Western Cape High Court.
The party wants the decision to close beaches along the Garden Route declared unconstitutional, unlawful and invalid.
President Cyril Ramaphosa declared the municipality a hotspot area, which means beaches there are closed until 3 January.
The garden route has seen a dramatic increase in COVID-19 infections, putting healthcare facilities under immense pressure.
The application is set to be heard on Monday.
