Another blow for Magashule as his court challenge to ANC suspension is dismissed─── 11:35 Mon, 13 Sep 2021
Suspended ANC Secretary-General Ace Magashule has suffered yet another blow, as his leave to appeal a court judgment upholding his suspension from the ANC has been dismissed with costs.
Magashule had approached the Gauteng High Court in Johannesburg to appeal a judgment by the same court in July that had dismissed his application to have his suspension from the ANC deemed unconstitutional and invalid.
Magashule was suspended by the governing party in May in a letter signed by ANC deputy secretary-general Jessie Duarte, in which the party said that he would be temporarily suspended until the outcome of his legal proceedings.
The Citizen reports he also wanted the court to uphold his attempt to suspend Cyril Ramaphosa as party president, but the court has not ruled in his favour.
The embattled Secretary-General was suspended in May in line with the ANC’s rule 25.70, which requires all party members criminally charged to temporarily step aside, pending the conclusion of their cases.
Magashule faces fraud and corruption charges in the Free State in connection with a R255 million asbestos project while he was the province’s premier.
This is a developing story.
