The two brothers accused of killing rapper and hip-hop star AKA are expected to appear in court again on 25 November, following a postponement to allow them time to consult with their legal representatives.

Siyabonga Gezani Ndimande, 30, and Malusi Dave Ndimande, 29, made their first appearance in the Durban Magistrates’ Court on Tuesday (11/11), following their extradition from Eswatini.

AKA, whose real name was Kiernan Jarryd Forbes, was shot dead in Durban on the evening of Friday, 10 February 2023. The award-winning artist was 35 years old.

The appearance of the Ndimande brothers followed an extradition request made by SA authorities, said KwaZulu-Natal NPA spokesperson Natasha Ramkisson-Kara.

“Interpol received the Ndimandes from their Eswatini counterparts at King Mswati III International Airport early (on Tuesday) morning.”

The surrender was undertaken in accordance with all the processes and procedures required in extradition matters, she added.

The Ndimande brothers appeared in court on charges detailed in the surrender order. This includes conspiracy to commit murder, four counts of murder, several counts of attempted murder, unlawful possession of firearms and ammunition, money laundering, and other related offences.


In August 2024, the Manzini Magistrate’s Court in Eswatini ruled that the Ndimande brothers were liable for surrender. The court further ordered that representatives from the South African Human Rights Commission (SAHRC) be present during the surrender process to ensure the accused’s rights were upheld during their transfer to South Africa.

“We can confirm that SAHRC officials were present in the Kingdom of Eswatini to observe all processes related to the surrender of the Ndimandes – including the arrest at King Shaka International Airport, their transfer to Durban Central police station for charging and processing, and their subsequent court appearance,” said Ramkisson-Kara.

KwaZulu-Natal director of public prosecutions Adv. Elaine Harrison extended her gratitude to Eswatini counterparts for their cooperation and commitment to justice.
