Free State landlords and tenants are being encouraged to approach the Rental Housing Tribunal (RHT) in the province to deal with conflict amicably.


Chief Director of Housing at the Department of Human Settlements in the province, Makalo Mohale, says the tribunal is an effective way to resolve disputes, as opposed to approaching the country’s courts, a process that can be long and arduous.

Mohale said this at the department’s stakeholder and information session at the Bram Fischer Building on the functions and operations of the tribunal in Bloemfontein today. It was revealed that while provision has been made for a tribunal in the Rental Housing Act 50 of 1999, the Free State has not had one till now. Mohale says five members of the tribunal are lawyers. Accommodation Unlimited’s Bennie Koen says landlords who have student accommodation, like them, often struggle with non-payment from their tenants. Koen said the tribunal does not have the power to evict tenants, so a landlord’s only option is to go to the courts, which is a lengthy and costly process. Mohale acknowledged the tribunal’s limitations.

He says while the tribunal is unable to evict tenants, it can assist in helping the landlord recoup their money before students move out by issuing an order for payment. It has been revealed the department will drive awareness regarding the tribunal so that tenants are made aware of their options. The Rental Housing Act 50 of 1999 aims to protect the interests of both the landlords and tenants and misconduct will be dealt with.
