The DA in the Free State has welcomed the High Court’s decision to dismiss the former PA of Ace Magashule's application to have her arrest and extradition declared unlawful and unconstitutional.

The party viewed the ruling as a significant step forward in the fight for justice and accountability in the asbestos scandal.

The application by Moroadi Cholota (37) was dismissed on Monday (26/8) in the High Court in Bloemfontein. Free State DA leader Roy Jankielsohn hailed the court’s decision as a victory for those committed to upholding the rule of law and ensuring accountability in the face of corruption.

“We believe this outcome will pave the way for further progress in addressing the serious issues surrounding the R255 million asbestos contracts case during the trial, which commences in April 2025,” Jankielsohn said.

Cholota (37), a PA to former Free State Premier Ace Magashule was arrested in the United States earlier this year and extradited to South Africa in August. After spending four months in custody, she was granted bail of R2,500 with strict conditions.

Cholota was initially expected to be a key witness in the asbestos case but has since been listed amongst several accused, including Magashule himself.

The asbestos project case centers on allegations of corruption and irregularities in the awarding of a housing audit tender in 2014. The R255 million contract was allegedly awarded to Limpopo businessman Edwin Sodi in collaboration with Diamond Hill Trading, a company owned by late Welkom businessman Igo Mpambani.

The Free State Department of Human Settlements is accused of irregularly awarding the tender, with kickbacks purportedly given to some of the accused.

The state alleges the accused were involved in multiple criminal activities, including fraud, corruption, and money laundering, linked to the asbestos roofing project. The 17 accused collectively face over 70 charges. They were previously released on bail ranging from R50,000 to R500,000.

The trial, scheduled for 15 April to 23 June 2025, is anticipated to uncover more details about alleged corruption surrounding the asbestos project.

The application by Cholota’s legal representative was dismissed on Monday (26/8) at the Free State High Court in Bloemfontein.
